These Terms of Service ("Terms") govern your access to and use of vitale.plus (the "Site") and your purchase of products from Vitalë, a brand operated by Ojash Wellness Inc. ("Vitalë", "we", "us"). By using the Site or placing an order you agree to these Terms, our Privacy Policy, Shipping Policy, Refund & Return Policy and Subscription Policy, which are incorporated by reference. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years of age and able to form a binding contract to purchase from the Site. Inner Peace™ is labelled for adults 18 years and older. By ordering, you confirm you meet this requirement. We sell and ship to addresses in Canada and the United States only.

2. Health and product disclaimer — please read

  • Inner Peace™ is a natural health product licensed by Health Canada (NPN 80147633). It is not a drug and is not intended to diagnose, treat, cure or prevent any disease.
  • Always read and follow the product label. Take only as directed. Consult a healthcare practitioner before use if you are pregnant or breastfeeding, taking medication, have a medical condition, or if symptoms persist or worsen. Drowsiness may occur; use caution when driving or operating machinery. Contains soy and oat.
  • Content on the Site — including descriptions of ingredients, references to published research, timelines, testimonials and reviews — is provided for general information and education. It is not medical advice and does not replace advice from a qualified healthcare professional. References to studies describe research on ingredients generally, at the doses and in the forms studied, and are not claims that Inner Peace™ will produce the same results.
  • Individual results vary. We make no guarantee of any particular health outcome. Any benefit statements about the product itself are limited to the uses authorised by Health Canada.
  • Stop use and seek medical attention if you experience an adverse reaction. You may also report adverse reactions to Health Canada.

3. Products, pricing and availability

  • All prices are in Canadian dollars (CAD) unless stated otherwise at checkout. Prices, promotions and shipping rates may change without notice; the price charged is the price shown at the time you place your order.
  • "Compare at" or "regular" prices shown against a sale or subscription price reflect the product's regular one-time price.
  • We may limit or cancel quantities per person, household or order, and may refuse or cancel any order we suspect is placed by a reseller, is fraudulent, or violates these Terms. If we cancel after payment, we will refund you in full.
  • Product images are for illustration; packaging may vary slightly from what is shown.
  • We make reasonable efforts to keep the Site accurate but do not warrant that descriptions, pricing or other content are error-free. We may correct errors and cancel affected orders.

4. Orders and payment

Your order is an offer to buy; our order confirmation email is acceptance. Payment is processed securely by Shopify Payments or the payment provider you select at checkout. You represent that you are authorised to use the payment method provided. Checkout may be completed directly from the product page.

5. Shipping, returns and refunds

Shipping terms, transit estimates and responsibility for duties and taxes are set out in our Shipping Policy. Returns, our 30-day money-back guarantee (first box only, return required) and refund conditions are set out in our Refund & Return Policy. Both form part of these Terms.

6. Subscriptions

By selecting Subscribe & Save you authorise us to charge your saved payment method for each recurring delivery at the frequency shown at checkout, until you cancel.

  • You may change, skip or cancel your subscription at any time by emailing support@vitale.plus from the email address you ordered with. We confirm every request by email within 1 business day.
  • Requests must reach us at least 48 hours before the next scheduled charge, judged by when your email arrives; changes made inside that window take effect on the following renewal.
  • Renewal orders are not refundable and are not covered by the 30-day guarantee, which applies to the first box of your first order only.
  • Subscription pricing is contingent on an active subscription. If you cancel, future orders are charged at the regular one-time price.
  • We may change the subscription price or terms with at least 14 days' notice by email; you may cancel before the change takes effect.

7. Promotions, discount codes and referrals

Discount codes are single-use per customer unless stated otherwise, cannot be combined, have no cash value, and may be withdrawn at any time. We may void discounts obtained through misuse.

8. Reviews and user content

By submitting a review, comment, photo or other content, you grant us a non-exclusive, royalty-free, perpetual licence to use, display and adapt it in connection with our business, and you confirm it is your own honest experience. We may moderate or remove content that is unlawful, misleading, makes health claims we cannot make ourselves, or otherwise violates these Terms. Reviews reflect individual experiences and are not a guarantee of results.

9. Intellectual property

The Site, the Vitalë and Inner Peace™ names and logos, packaging, images and copy are owned by or licensed to Ojash Wellness Inc. and protected by Canadian and international law. You may not copy, reproduce or use them without our written permission, other than to view the Site and place orders.

10. Acceptable use

You agree not to: use the Site for any unlawful purpose; place fraudulent or bulk orders for resale; interfere with the Site's security or operation; scrape or harvest data; or misrepresent your identity or age.

11. Disclaimer of warranties

Except as expressly stated in these Terms or required by applicable law, the Site and products are provided "as is". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Nothing in these Terms limits the statutory rights of consumers that cannot be excluded under the laws of your province, territory or state.

12. Limitation of liability

To the fullest extent permitted by law, Ojash Wellness Inc., its directors, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, arising from your use of the Site or products. Our total liability to you for any claim arising from an order is limited to the amount you paid for that order. Some jurisdictions do not allow certain limitations; in those places our liability is limited to the greatest extent permitted.

13. Indemnity

You agree to indemnify and hold harmless Ojash Wellness Inc. from claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the products (including use contrary to the label), or content you submit.

14. Third-party services

The Site uses third-party services (for example Shopify, payment processors, review and analytics providers). Their use of your information is governed by their own terms and our Privacy Policy. We are not responsible for third-party websites linked from the Site.

15. Governing law and disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the courts of Ontario, except where applicable consumer-protection law gives you the right to bring a claim where you live. Before starting any formal proceeding, you agree to contact us at support@vitale.plus and allow 30 days for us to try to resolve the issue.

16. Changes to these Terms

We may update these Terms at any time by posting the revised version on the Site with a new "Last updated" date. Changes apply to orders placed after they are posted. Continued use of the Site means you accept the revised Terms.

17. General

If any provision of these Terms is held invalid, the remainder stays in effect. Our failure to enforce any right is not a waiver. These Terms, together with the policies referenced above, are the entire agreement between you and us regarding the Site and your purchases.
